1. This enrollment is for a one year period of time, beginning on effective date in the agreement.
2. A minimum of three people from dealership are required to complete our AgAwareness training; one each from sales, parts and service. The dealership will not be recognized as “Certified Agriculture” until these three people complete their training. Beyond the three
required trainees, dealer is encouraged to put as many people from any/all departments as they want through our training, at no extra cost.
3. You are agreeing to an annual enrollment in the Certified Agriculture program at the level selected during sign up. As such, dealer is required to pay the monthly fee, at the beginning of each month of this agreement, until such time this enrollment is cancelled per the terms defined in bullet 9 Auto Renew, or bullet 10 Early Termination. It is understood the enrollment fee cited herein is for the individual franchise as noted in the application. This enrollment does not include access or rights to the tools, services, resources or products of The Certified Agriculture Group for any store other than that named, which may include additional stores that share ownership with the store named.
4. On the enrollment form, Dealership indicated which discounts Dealership felt it qualified for. Upon verification, Dealership will be notified in writing, and monthly discounts will be applied beginning immediately. In the event discount qualifications cannot be verified, Dealership will be notified in writing, with an invitation to continue working on verification. However, discounts will not be applied until successful verification of qualifying criteria has occured.
5. In the event Dealer wishes to change their enrollment level during the term of this agreement, Dealer will be required to complete a simple “Service Change” form. This form will acknowledge and accept the new monthly fee and associated assets, as well as re-set the effective date of future renewals to one year from the date of the Service Change. All other terms & conditions in this agreement will still be valid.
6. At the time of a qualifying agricultural sale, dealer is required to enter the transaction in the AgPack Redemption System, which consists of completing customer data fields, customer’s AgPack ID# and the vehicle’s VIN.
7. In the event Dealer fails to enter their customer into the AgPack Redemption System, customer will be empowered to submit their own AgPack claim by successfully submitting a valid Bill of Sale from their purchase. CAD reserves the right to charge additional fees to the enrolled dealer, if they repeatedly fail to service their customers.
8. Exclusivity: Exclusivity may be an option, but will be limited to the brand of the requesting franchise, and within a mutually agreed geography. Requests for brand exclusivity will be reviewed by members of the Dealer Advisory Council and senior CAD leadership. If approved, the approved franchise(s) will be required to pay an additional exclusivity fee.
9. Auto Renew: This enrollment will automatically renew annually, on the anniversary of its effective date, unless dealer provides written opt out no less than 30 days in advance of enrollment anniversary. Dealer will be sent an email reminder of the approaching deadline no less than 60 days prior to the auto renewal. If dealer does not opt out in writing a minimum of 30 days preceding their enrollment anniversary, there will be no refunds, and no exceptions to the terms of this agreement for the following 12 months. All communication, including auto renewal reminders will be sent to the Points of Contact (POC’s) provided below. CAD will put forward reasonable efforts to maintain a current list of POC’s, but will not be responsible if dealer does not participate in regular communications, or provide updated POC information in a timely fashion.
10. Early Termination: Dealer has the right to terminate their AgTruckTrader.com subscription at any time during the term of this agreement, with a written 120 day Notice of Intent to Terminate. During that 120 day period, Dealer is required to continue compensating CAD fees as agreed above in Bullet 3. During that 120 days, Dealer agrees to good faith efforts working with CAD staff identifying, addressing and resolving Dealers concerns. In the event these concerns cannot be overcome, early termination will be honored.
11. Dealer is required to provide an automated form of payment, per this agreement. Dealer understands, and accepts, the form of payment provided per this agreement will be charged the monthly subscription fee at the beginning of each month, as well as any additional fees the dealer approves for extra products and/or services requested during the term of this agreement.
12. Dealer is required to provide CAD its inventory syndication provider, per this agreement. Dealer understands, and accepts, that by this information they are granting CAD permission to contact their inventory syndication provider for the purpose of adding dealer’s AgPack eligible inventory to AgTruckTrader.com.
13. Items in the CAD Store, services or supplies not specifically included as part of the above benefits summary, may carry additional fees. These can include, but are not limited to:
- Access to agriculture lead lists
- Exclusive campaigns, assets and pricing from DTN Progressive Farmer & 8Point Marcomm
- Agricultural trade show and/or Dealer Event planning and staffing services
